TLC Fine Letter - Need Attorney
Hey guys today I got a letter in the mail requesting that I pay $5625 in fines but settle for $2625 in fines without hearing due to my operation of a handicap cab without a handicap certification 75 times in the past year. Is there any chance I could get it pleaded down in TLC court and to what amount? Who is the best taxi attorney in New York City?

Last year, i Drove an accessible vehicle 18 times, without knowing that i need such training, no one told me about , even the Garrage i leased the cars (were different cars) never montion or release information that its illigale to drive an accessible vehicle without proper traing, if i know that i could refuse drive those accessible cars, this garrage has maybe 50% of its cars are accessible. this is a responssibility of the garrage not the driver. why TLC let them rent those car to any driver and not letting them know about the rules if there any, most of the time they send me home bacause there is no cars availble at all. I'm seek and tired from TLC Hidden rules. NOW, IN Total i would face $1,350 But they say Settlement offer in 30 days will be $630. - i need help with this matter, please send suggestions and information what i should do

i got the same letter that i drove on 12 occasions and settle for $420 what the hell is this? i didnt know u needed to get training to drive that bull wheelchair car...why the hell did the garage give me the car im sure they knew? This is bull! WHAT DO WE DO? someone help!!!!

I got the same letter today, but they are fining me 980 dollars, and my partner got fined 350 dollars. The tlc is holding us hostage and forcing us to pay this fine or they will suspend our license. This is absolutely complete bullshit. They want us to pay the fine within 30 days of the date on the letter. The date of the letter is 12/23/11 and we received it on 1/8/12. That leaves us with about two weeks to pay these fine or get our licenses suspended. Something is rele wrong here. They are blackmailing us by saying if you plead guilty the fine is 35 dollars per ticket, or if you plead not guilty then the fine will be 75 dollars per ticket. They want us to make a rational decision with a gun pointed to our heads. In my opinion we should all fight this and put not guilty. I plan on writing to all the news outlets with my story and suggest everyone in this situation do the same. As well as write to the mayors office. You can do it online, here is the link:

I recommend for now just go to the tlc office and plead not guilty and wait for your hearing date. I rather fight this and pay 2000 dollars extra then just settle with them. They are treating us like garbage!

The TLC makes its money off of drivers, not the city. The mayor likes it just fine that way. They got me and a few other young guys at our garage for not using EZpass. The garage did not have EZpass installed and was perfectly happy to let us continue racking up fines without saying a word. The city does not want the TLC to be on its payroll, so it does not mind if the TLC teams up with garages to rob politically helpless poverty stricken foreigners.

This is a good cause but I also suggest thatyou visit TLC website to read §54-04 Section (n) 1-4: Licensing– Requirements Section. Ignorance of the law is no excuse but think if I wereoperating in such environment where 50% of the cabs are handicapped, I will doall I can to increase the chances of getting a cab by complying with rulesgoverning handicapped vehicle operations in section (n) 1.
What would you do if the garage refused to give you the vehicle for lack ofproper training? You are a professional and the system expects you to take theextra step to comply with its rules, do it for your own benefit and let themanagement know your dilemma – not just TLC. The $75 or more fines, time, legalcosts and frustration are unwarranted.

When I attended Taxi school, they never mentioned any special certificate for the wheelchair, so how would any of the drivers know, you really thing any of them read the rule book, at the very least the garages could have had it posted. It is bullshit and now they/re about to fine drivers $100 PER HOUR for working over the 12 hour shift, how many times have you come back late due to circumstances?

Youhave to be mindful of the fact that the TLC is always making new rules andadopting them without regards to whether you know it or not. For the most part,they call public hearings before these rules become law for implementation. Haveyou ever attended any of these public hearings? Probably not; but it's yourprofessional duty to now and read what changes if any that the TLC is implementing– this is your bread and butter.
This is what thelawyers are doing too. They are not drivers but what affects this industry is abread and butter issue for them; therefore, they are vigilant for rules made bythe TLC. This agency is commissioned and delegated to write rules andregulations governing operations of the Taxi business and all their rules are withinpublic purview – on their website.
The most logical person to blame is the Taxi advocacy groups like, the New YorkTaxi Workers Alliance headed by Bhairavi Desai. That organization is chargedwith advocating for you. Therefore, if you don’t see or learn the regulation inTaxi Schools it’s your duty to alert them – they will take actions but yourlone voice is not of any help – we need collective voice. Finally,the presumption is; Ignorance of the law is no excuse. Simple home work likereading into new rules and regulations at the TLC website is overlooked by mostdrivers. But if you take this business seriously, then you should take anypronouncement on this website religiously - at all times.
